This Privacy Policy describes how Best Suited Resources, LLC d/b/a Best Suited Business Solutions ("we," "us," or "StayClosd") collects, uses, and discloses information when you use the StayClosd software service available at stayclosd.com and app.stayclosd.com (the "Service"). By using the Service you consent to the practices described below.
1. Information we collect
Account information. When you create an account, we collect your name, email address, brokerage or lender affiliation, profession (real estate agent or loan officer), market or service area, and any optional profile data you provide (phone number, headshot).
Contact lists you upload. When you import or enter contacts, we store the names, email addresses, phone numbers, mailing addresses, optional birthday and closing-anniversary dates, tags, and notes you associate with each contact. You are responsible for the accuracy of this data and for having a lawful basis to email each contact.
Payment information. Subscription payments (Growth, Pro, Elite) are processed by Stripe. We do not see, store, or have access to your full credit-card number; Stripe issues us a token that represents the payment method. Separately, the gifting program tokenizes a card-on-file through Very Good Security (VGS) on behalf of our gifting partner Goody Commerce. The gifting card is held by Goody and is charged only when one of your past clients claims a prize they won.
Gifting recipient data.When a contact wins a prize, the contact's name, email address, and shipping address (where applicable) are transmitted to our gifting partner Goody Commerce to fulfill the gift. We also store the product they chose, the catalog image URL, and the gift amount on the prize-result row so we can surface the win in subsequent broadcasts as social proof.
Usage data. We log application events such as logins, broadcast generations, sends, opens, clicks, poll/trivia/survey responses, and gift-claim events. IP addresses and user-agent strings are captured in webhook payloads from our delivery providers.
Cookies and similar technologies. We use first-party cookies to keep you signed in (Supabase session cookie on app.stayclosd.com) and to remember preferences. We do not use cross-site tracking, advertising, or behavioral cookies.
2. How we use information
We use the information we collect to: (a) operate the Service, including delivering the monthly email broadcasts you approve to the recipients you provide; (b) generate AI- assisted broadcast drafts using Anthropic's API; (c) look up property valuations and market data via Rentcast; (d) fulfill prize drawings and birthday/anniversary gifts through Goody Commerce; (e) process subscription payments and prevent fraud via Stripe; (f) measure engagement and present analytics back to you; and (g) communicate with you about your account, service updates, and support.
We do not sell your personal information, your recipients' personal information, or use your data to market third-party products. We do not send promotional email on our own behalf to your contacts.
3. Subprocessors
We rely on the following third-party service providers ("Subprocessors") to operate the Service. Each has its own privacy policy and data-processing terms:
- Supabase — managed Postgres database, authentication, and storage
- Vercel — application hosting and serverless functions
- Stripe — payment processing and subscription billing
- Resend — transactional and bulk email delivery
- Anthropic — large-language-model API for draft generation
- Rentcast — property valuation and market data
- NeverBounce — email address validation on import to protect sending reputation; emails are sent only to determine deliverability and are not used for marketing or resale
- Goody Commerce — gift catalog and fulfillment
- Very Good Security (VGS) — payment-card tokenization for gifting
- Upstash — rate limiting and ephemeral key/value storage
- Holiday Calendar API — daily holiday metadata referenced in broadcast footers
4. Disclosure
We disclose information only as necessary to operate the Service through the Subprocessors listed above, to comply with applicable law, to respond to valid legal process, to protect the rights and safety of the Service or its users, or in connection with a merger, acquisition, or sale of assets in which the acquirer assumes equivalent obligations.
4.1 Financial relationship with the gifting partner
We have a commission-based affiliate relationship with Goody Commerce, our gifting partner. When you fund a gift through the Service, Goody pays us a commission on that transaction out of their own margin. No additional fee, surcharge, or markup is added to the gift amount you set — your card is charged only the gift amount you choose. We are paid the same commission regardless of which gift the recipient picks from the catalog, and this relationship does not influence which gifts are shown to you or your recipients. The gifting program is a required component of every plan (including paid plans); see our Terms of Service for additional detail.
5. SMS / text messaging consent
When you provide your mobile phone number and explicitly consent to SMS messaging through the SMS notifications setting in your account, we store the consent timestamp, the IP address from which the consent was given, and the exact disclosure text you agreed to. Consent is per-mobile-number; if you change or remove your mobile number, the prior consent is cleared and you must re-opt-in to resume receiving SMS.
All the categories of information described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging services strictly for the purpose of delivering your messages.
Specifically, your mobile phone number, opt-in timestamp, IP address, and consent text are never sold, licensed, transferred, or otherwise disclosed to third parties for marketing, advertising, lead generation, or any purpose other than operating the SMS messaging service we provide to you.
6. Recipient unsubscribe and complaints
Every email we send on your behalf includes a one-click unsubscribe link. When a recipient unsubscribes, marks the message as spam, or hard-bounces, we flag the contact and stop sending. You retain the contact row in your dashboard and can delete it from the contacts page.
7. Data retention
We retain account and contact data for as long as your account is active. Cancelling a paid subscription moves your account to the free Starter plan; the account remains active and data is retained. To fully delete your data, request account closure by emailing hey@stayclosd.com. After account closure, we delete or anonymize personal data within 30 days, except where we are required by law to retain it longer (for example, financial records retained by Stripe under their policy, typically seven years).
Past-prize records (winner name, gift chosen, catalog image URL, claim date) are retained for the lifetime of the account so they can be surfaced as social proof in future broadcasts. On account closure these records are deleted alongside other personal data.
8. Your rights
You may access, correct, export, or delete your account data at any time through your dashboard or by emailing hey@stayclosd.com. Depending on where you live, you may have additional rights under California, Texas, or other applicable law, including the right to know what data we hold and the right to object to certain processing. We will respond to verifiable requests within 30 days.
9. Security
We use row-level security on every per-agent database table so one customer's data is not accessible to another customer. Webhook payloads are signature-verified. Admin endpoints are allow-listed. Content Security Policy headers, HTTP Strict Transport Security, and other standard hardening measures are applied. No method of transmission or storage is 100% secure; we make no warranty of absolute security.
10. International users
The Service is operated from the United States. If you access it from outside the U.S., you consent to the transfer and processing of your information in the United States, which may have different data-protection laws than your jurisdiction.
11. Children
The Service is not directed to individuals under 18. We do not knowingly collect personal information from minors.
12. Changes
We may update this Privacy Policy from time to time. Material changes will be announced by email to the address on file at least 14 days before they take effect.
