Giveaway Official Rules

These Official Rules govern the monthly, quarterly, and annual prize drawings (each, a "Giveaway") offered through the StayClosd platform on behalf of participating real-estate professionals. By participating, you agree to be bound by these rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Giveaway.

1. No purchase necessary

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.A purchase or payment will not improve your chances of winning. Entry is free and is completed by responding to the engagement question (the "Poll") included in the email newsletter you received from the participating real-estate professional.

2. Sponsor and Prize Provider

The "Sponsor" of each Giveaway is Best Suited Resources, LLC, a Texas limited liability company doing business as StayClosd, with a principal mailing address at 8350 N Central Expy STE 1900, Dallas, TX 75206. The "Prize Provider" for any individual Giveaway is the real-estate professional whose name appears in the sender line and footer of the email announcing that Giveaway. The Prize Provider funds the prize; StayClosd administers entry collection, winner selection, and prize fulfillment through its third-party gifting partner.

3. Eligibility

The Giveaway is open only to natural persons who are (a) at least 18 years of age (or the age of majority in their state of residence, whichever is greater); (b) legal residents of the fifty (50) United States or the District of Columbia; and (c) the intended recipient of the Prize Provider's newsletter at the email address to which the entry message was sent. Employees, officers, directors, agents, and immediate family members of StayClosd, the Prize Provider, and their affiliated brokerages are not eligible. The Giveaway is void in Puerto Rico, the U.S. Virgin Islands, all U.S. territories and possessions, and where prohibited by law.

4. Giveaway period

Each monthly drawing's Giveaway Period begins on the date the entry email is sent by the Prize Provider and ends at 9:59 a.m. Central Time on the draw date stated in that email. Quarterly drawings cover a three-month entry window and annual drawings cover the full calendar year. The draw date for each Giveaway is set by the Prize Provider through the StayClosd platform and is disclosed in the announcing email.

5. How to enter

To enter, click any one of the answer choices in the Poll inside the newsletter email during the Giveaway Period. Each eligible recipient may enter the monthly drawing at most one (1) time per Prize Provider per calendar month. Quarterly entries accrue from monthly entries during that quarter. Annual standings accrue from year-to-date engagement points (10 points per Poll response plus any bonus engagement points the platform awards).

Entries that are illegible, incomplete, falsified, late, generated by automated means, or otherwise not in compliance with these rules are void. Sponsor reserves the right to disqualify any entrant who tampers with the entry process or who acts in violation of these rules.

6. Winner selection

Monthly and quarterly drawings. One (1) winner per Prize Provider per drawing period is selected by random drawing weighted by the number of entries accumulated during the relevant period.

Annual (year-end) drawing. The Prize Provider chooses one of two selection methods for the annual drawing and that choice is disclosed in the newsletter footer of every entry email for the applicable year:

Single Winner. The contact with the highest year-to-date engagement points on December 31 wins. If two or more contacts are tied for first place, a random tiebreaker is performed among the tied contacts.
Top-3 Raffle. The three contacts with the highest year-to-date engagement points on December 31 are entered into a random drawing; one winner is selected at equal probability among the three finalists.

Random selections are made by StayClosd's automated drawing system. Odds of winning depend on the number of eligible entries received and, for the annual drawing, on year-to-date engagement totals. Drawings are conducted on the draw date stated in the announcing email.

7. Prize

The prize for each Giveaway is the gift, gift card, or merchandise credit identified in the announcing email, with the approximate retail value stated as the prize value. Prizes are fulfilled through StayClosd's third-party gifting partner; the winner selects an available item at or below the stated prize value from a curated catalog. Only one (1) prize per winner per drawing. Prizes are non-transferable and may not be exchanged for cash, except at the sole discretion of the Sponsor.

8. Winner notification and claim

The winner is notified by email at the address on file within seven (7) days of the drawing. The notification email contains a personalized claim link. The winner must complete the claim form within fourteen (14) days of notification or the prize is forfeited and an alternate winner may be selected at the Sponsor's discretion.

9. Taxes

The winner is solely responsible for all federal, state, and local taxes on the prize. If the prize value (combined with any other prizes the winner has received from the same Sponsor or Prize Provider in the same calendar year) is $2,000 or more, the Sponsor or Prize Provider may be required to issue an IRS Form 1099-MISC and collect the winner's Social Security number or Taxpayer Identification Number prior to releasing the prize.

10. Privacy

Information collected from entrants is handled in accordance with our Privacy Policy. Entrants' contact information is used by StayClosd to administer the Giveaway, by the Prize Provider to maintain its existing business relationship with the entrant, and by the third-party gifting partner solely to ship or deliver the prize to a confirmed winner.

11. Release and limitation of liability

By entering, each entrant releases and holds harmless the Sponsor, the Prize Provider, their affiliated brokerages, the third-party gifting partner, and each of their respective officers, directors, employees, and agents from any and all claims, losses, damages, costs, or expenses (including attorneys' fees) arising out of or in connection with the Giveaway, including without limitation any prize-related activity, prize delivery, or any negligence by the released parties. Some jurisdictions do not allow limitations on certain warranties or liabilities, so the foregoing limitations may not apply to you.

12. General conditions

The Sponsor reserves the right to modify, suspend, or terminate any Giveaway if, in its sole discretion, the Giveaway cannot be conducted as planned due to fraud, technical failure, force majeure, or any other cause beyond its reasonable control. The Sponsor may disqualify any individual it determines, in its sole discretion, has tampered with the entry process, has acted in violation of these rules, or has otherwise acted in an unsportsmanlike or disruptive manner.

The Giveaway is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Giveaway is subject to the binding-arbitration provisions in our Terms of Service.

13. Winners list and contact

For the name of the winner of any concluded Giveaway, or for a copy of these Official Rules, send a self-addressed stamped envelope to: StayClosd Giveaway Winners, 8350 N Central Expy STE 1900, Dallas, TX 75206, or email hey@stayclosd.comwith the subject line "Giveaway winners list" identifying the Prize Provider and drawing month.

14. Real estate disclosure

Entry in any Giveaway is not, and shall not be construed as, an inducement to use, continue using, or refer business to the Prize Provider or any settlement-service provider. No purchase, listing, referral, or other real-estate transaction is required to enter or win, and no prize is contingent on any such transaction or on the referral of any third party.
